Public Health Photo Contest Winner
Official Rules

These rules govern your participation in the Johns Hopkins Bloomberg School of Public Health Photo Contest ('Contest'). Participation in the Contest constitutes your full and unconditional agreement to and acceptance of these rules:

(1) Entry Period: You may enter the Contest from February 12 - March 30, 2007 ('Contest Period'). The Contest is sponsored and run by The Johns Hopkins Bloomberg School of Public Health at 615 North Wolfe Street, Baltimore, MD 21205 USA.

(2) Eligibility: The Contest is open to faculty, staff, students and alumni of the Johns Hopkins Bloomberg School of Public Health ("the School"), anyone with a jhsph.edu email address.

The School is not responsible for late, lost, delayed, damaged, misdirected, incomplete, illegible or unintelligible entries. Incomplete, illegible, or unintelligible entries are not eligible.

The Contest allows five (5) photos per entrant, and the School will treat the person who holds the email address of an eligible photo submission as the contest entrant.

To be eligible an entrant must be the sole author and copyright owner of the photo. Any materials that infringe on the rights of any third party (i.e., materials used without express permission of the copyright owner) may not be used.

(3) How to Enter: The Johns Hopkins Bloomberg School is asking you to help promote the School and its mission. The entry requirements are as follows:

Take a photo that relates to public health.

Have a jhsph.edu email address and then upload your photo at the following site http://commprojects.jhsph.edu/photocontest/login.cfm.

Specify where the photograph was taken and supply a caption that describes how the photo illustrates an aspect of public health.

If you submit a photo that does not comply with the Rules of Consent,* your entry will automatically be disqualified. The applicable Rules and the terms, conditions and policies are posted at http://commprojects.jhsph.edu/photocontest. The School reserves the right to disqualify any entry that violates these Rules and any terms, conditions or policies.

The public may vote on contest entries which will be featured on a website from April 2 to April 8, 2007. (There will be checks in place to ensure that one person may vote only once per day.)

(4) Format of Entries: Entries must be submitted in JPEG format. If the image size is less than 1024x768, to be eligible as a winner (under Rule 5,) the entrant must have a high resolution version available on request.

(5) Use of Photos: By submitting a photo as part of the Contest, you agree to grant a non-exclusive, irrevocable, royalty-free license for full and unrestricted use of that photo to the School. The School reserves the right to evaluate each entry's eligibility under the Rules as well as for compliance with the U.S. Copyright Act and any and all other applicable laws.

By submitting an entry you are representing and warranting that the subject in your entry is authorized to be photographed and included on the School's website, in publications promoting the School and its mission and may be used in the School's magazine, Johns Hopkins Public Health.

The School reserves the right to crop your photograph for editorial use.

Contest participants understand that when the contest is over, their entries may be selected for inclusion in the School's general photograph collection and may be used for educational use promoting health and development.

The School's photography collection falls under the category of editorial photography. Unlike commercial photography — which is usually obtained for promotional purposes through contracts with professional photographers and stock agencies — editorial photography calls for a journalistic approach to taking and using photos. In other words, editorial photography is intended for objective, accurate representation or illustration of a real situation, subject or physical location.

The images added to the School's photo collection through this contest are strictly for non-profit, educational use promoting public health under the principles of editorial photography. They may be used to portray the people, stories and issues related to public health. We expect entrants to respect human photo subjects and take into consideration whether photo subjects may experience negative consequences of having their photo used. The value and importance of using a photograph should always be weighed against regard for the photographic subjects' reputation, privacy and integrity. Please see the Best Practices page.

(6) Judging: The winning entries will be selected by the Dean, Michael J. Klag, and staff in the School's Office of Communications and Public Affairs, as determined by highest overall grading score from all eligible entries received during the judging period according to the following criteria:

The photographs receiving the most popular votes through the School's website during the voting period (25% of overall grade).

Creativity (25% of overall grade).

Production quality (25% of overall grade).

Relevance to School's mission (25% of overall grade).

All voting decisions are final. The School reserves the right to disqualify any entry that is, in the School's discretion, inappropriate, offensive or demeaning to the School's reputation or goodwill, or contrary to the School's mission or these rules.

Once the selection of winning entries has been completed, we will notify the winning entrants via email and the contact information provided. If a winner fails to respond within 7 days of the date of the notification, that winner will be disqualified and the next highest scoring photo will be selected as an alternate winner and notified according to this procedure. If a winner fails to submit a high resolution version of their winning photo within 7 days, that winner will be disqualified and the next highest scoring photo will be selected as an alternate winner and notified according to this procedure.

(7) General Terms and Conditions: By participating, entrants agree that the parties are not responsible or liable for, and are released and held harmless from: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) any condition caused by events beyond the control of School that may cause the Contest to be disrupted or corrupted, including without limitation the functioning or lack thereof of the http://commprojects.jhsph.edu/photocontest site; (iii) any printing or typographical errors in any materials associated with the Contest; (iv) any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from participation in the Contest or acceptance of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. The School reserves the right, in its sole discretion, to suspend or cancel Contest at any time if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Contest. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of participant in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Maryland, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Maryland or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Maryland.

(8) Privacy: By entering into this Contest you consent to the use of your name as set out in the School's Privacy Policy, available at http://www.jhsph.edu/resources/web_policies, regarding use of all material entered and/or submitted for this Contest. Please note that as a condition of uploading a photo to the School's contest website you may be required to agree to and comply with the School's privacy policy.

(9) Digital Millennium Copyright Act (DMCA) Compliance: The School complies with the provisions of the DMCA. As such, a Designated Agent has been established with proper documentation sent to the U.S. Copyright Office. If you have a concern regarding the use of copyrighted material on a site please contact the agent designated to respond to reports alleging copyright infringement. The designated agent for The Johns Hopkins Bloomberg School to receive notification of claimed infringement under Title II of the DMCA is: Wesley Blakeslee. He may be contacted at starman@jhu.edu.
